ACCEPTANCE OF TERMS

Your access to and use of No Limits ("the Website") Trackdays Ltd is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.

DEFINITIONS

  1. "Buyer" means the individual or organisation who buys or agrees to buy the Goods from the Seller;
  2.  "Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;
  3. "Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;
  4. "Goods" means the articles that the Buyer agrees to buy from the Seller;
  5. "Seller" means No Limits Trackdays Ltd., Unit 4, Black Horse Barns, Fancott, Toddington, Bedfordshire, LU5 6HT;
  6. "Terms and Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller.

CONDITIONS

  1. Nothing in these Terms and Conditions shall affect the Buyer's statutory rights as a Consumer.
  2. These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
  3. Payment of Goods shall be deemed conclusive evidence of the Buyer's acceptance of these Terms and Conditions.
  4. Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

CHANGES TO WEBSITE

No Limits reserves the right to:

  1. change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that No Limits Trackdays Ltd shall not be liable to you for any such change or removal; and
  2. change these Terms and Conditions at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.

MAKING A PURCHASE

Making a trackday purchase could not be easier. Please navigate to the track event you wish to purchase and select the package you would like. It is important that all riders choose the group that is suitable to their ability. If riders are found to have chosen a group not suitable this could result in delayed tracktime or loss of tracktime until a place is found in the appropriate group or loss of payment if a group is not available.(please see group definitions).

We accept Visa, Mastercard, Delta, Maestro & Solo cards, Paypal and American Express.

When confirmation of order is received, this indicates that we have received your order and hence a contract between us. We reserve the right to amend/adjust pricing with prior notice if a mistake has been made in pricing or packages advertised or if we are no longer able to supply a particular product for some reason. In the case of a change of price/package, we will always contact you first to ensure that the price is acceptable.

No Limits Trackdays Limited, offers a ‘Cash On the Day’ scheme, this payment by cash only, however, there are strict conditions to this. The customer must have a trading history with No Limits Trackdays Limited, they must provide a Valid credit or Debit card to secure the bookings and accept the full terms of conditions, there is a charge of £1.00 for these bookings. Card payments will not be accepted by staff on the day.

For COD’s, the terms are the same as making and paying for an event in full. All cancellations are subject to charges and should the rider not attend, No Limits reserves the right to charge the card for the full amount of the day without prior consent.

ORDERING

  1. All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.

BOOKINGS VIA A THIRD PARTY WEBSITES

All booking via a third party will be placed in accordance with both parties’ terms and conditions, all questions and queries should be made direct to the third party at all time unless there is a specific reason and agreement for you to deal direct with the No Limits Trackdays Limited.

GUARANTEE

The Seller warrants that the Goods will at the time of dispatch correspond to the description given by the Seller. Except where the Buyer is dealing as a Consumer, all other warranties, conditions, or terms relating to fitness for purpose, merchantability, or condition of the Goods, whether implied by Statute, common law or otherwise are excluded, and the Buyer is satisfied as to the suitability of the Goods for the Buyers purpose.

PRIVACY POLICY

No Limits Trackdays Ltd do not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.

Any personal details that buyer provides are kept private and secure. To receive updates and newsletter the buyer will be required to opt into this facility and the buyer reserves the right to opt out, by either telephoning the office or sending an email requesting to be removed from the mailing lists.

LINKS TO THIRD PARTY WEBSITES

The Website may include links or recommendations to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.

COPYRIGHT

  1. All copyright, trademarks and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to No Limits Trackdays Limited or otherwise used by No Limits Trackdays Ltd as permitted by law.
  2. In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold, or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Website for personal, non-commercial home use only.

CANCELLATION POLICY *

For European bookings

Cancellation 45 days or more notice, (from the event start date):

Loss of deposit paid.

Cancellation Between 31 Days and 44 Days (from the event start date):

Loss of deposit paid and subject to a 20% charge of the full amount of the event, including any additional accommodation costs, no refund, credit note only.

Cancellation of less than 30 Days (from the event start date):

No refund or credit.

For International bookings

Cancellation policy for international events: Upon booking, you will be entering into an agreement and payment of £500.00 deposit will be required to secure the basic international track event.

  • Cancellation up to 120 days prior to the event, 30% cancellation fee of the event cost.
  • Cancellation between 90 and 120 days prior to the event, 50% cancellation fee of event cost.
  • All cancellation after 90 days prior to the end, no refund.

Payment of the entire event must be paid no later than 120 days before the first day of the event; this is the first night of the accommodation.

Visa and passport are required for all international trips, and these are the duty of the client not No Limits Trackdays Limited.

Insurance will also be required, please ensure that you have international repatriation cover (including all stop over locations and commencing from the date you leave the UK to the date of return).

CARNETS

Since the UK has left the UK it is necessary under the HMRC export and import rules for No Limits Trackdays to complete  a carnet for each vehicle carrying the motorcycles to   an European event , where transportation is included in package.

No Limits  Trackdays  has an online registration system  for this on  https://nolimits-carnet.web.app/#/home,

It is imperative that this is complete no later than 10 days prior to the bike drop off date, it must include the Manufacture of bike, value, colour, VIN or frame number, model and also all the items that you are taking on the stillage.

Failure to complete this can result in your bike not being unable to be transported under the No Limits Carnet and may  result in additional fees for a production of an individual carnet.

For Trackday bookings in the UK

Cancellations of 22 days or more of the date of the event

Full refund or credit (valid for a period of 12 months) less an administration cost of

£20 per person

Cancellations of 8 to 21 days or more of the date of the event

Credit (valid for a period of 12 months) less an administration cost of £20 per person

Cancellations of 7 Days and less than of the date of the event

No refund, no credit note.

Cancellations of UK Track Events on the day by the Track Owners

If the day is cancelled in full, all riders (except for TTR’s/POD’s) will receive a credit valid for a period of 12 months from that date. This will include customers who have not registered but paid in full.

Cancellations of COD’s for any event

For COD’s, the terms are the same as making and paying for an event in full. All cancellations are subject to charges and should the rider not attend, No Limits reserves the right to charge the card for the full amount of the day without prior consent, this will include the £1.00 charge for this service.

*In the event of Force Majeure please refer to the section title “Force Majeure” below.

 

CHANGE OF NAME

We can change the name of riders on any bookings with no additional costs on all UK Bookings, however, European bookings are liable to an administration costs, these will vary to the time of cancellation and the event.

RIGHTS OF SELLER

  1. The Seller reserves the right to adjust the price and specification of any item on the Website at its discretion.
  2. The Seller reserves the right to withdraw any goods from the Website at any time.
  3. The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.

LIMITATION OF LIABILITY

  1. Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the Price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.
  2. Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Sellers agents or employees.

WAIVER

No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

FORCE MAJEURE

The Seller shall not be in breach of these Terms and Conditions and/or any contract between the Seller and the Buyer which is subject to these Terms and Conditions nor liable for delay in performing, or failure to perform, any of its obligations thereunder if such delay or failure results from a Force Majeure Event (as defined in these Terms and Conditions).

In the event of a Force Majeure Event occurring, the Seller will notify the Buyer of its occurrence and the likely impact of such a Force Majeure Event (if known or can be foreseen at that time).

Unless notified otherwise by the Seller, if the Force Majeure Event impacts a track day event booked by the Buyer, the Buyer must attend the event and complete the sign on procedure in order to be entitled to any credit offered by the Seller in respect of the event where the event is cancelled, or the track is closed prematurely on the day due to the Force Majeure Event.

In all other circumstances, unless otherwise notified in writing by the Seller, the issue of any credit (full or partial) due to any Force Majeure Event is at the entire discretion of the Seller.

In all circumstances, the Seller is not liable for any additional costs, expenses, and/or losses of any kind and however caused which arise out of or in connection with a Force Majeure Event (including but not limited to travel costs, accommodation costs, subsistence costs, and/or loss of earnings).

The Seller is not liable for any costs, expenses, and/or losses of any kind and however caused which arise out of or in connection with a Force Majeure Event which are covered by any insurance policy which the Buyer has or is required to have as a pre- requisite to attending or participating in an event provided by the Seller.

A “Force Majeure Event” means an event which is beyond the reasonable control and contemplation of the Seller including but not limited to events commonly attributed to act(s) of God, war, riot or civil unrest, malicious damage, compliance with any law or governmental or regulatory order, rule, regulation, or direction, accident, breakdown of plant or machinery, fire, flood, storm, tempest, disease (whether or not classified as an epidemic or pandemic by the relevant governmental authorities at the relevant time), industrial dispute (not involving the personnel of the Seller), and/or any action or inaction of or by any third party supplier (including any circuit provider or organiser) on whom the Seller relies for the performance of its own obligations.

SEVERANCE

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

CHANGES TO TERMS AND CONDITIONS

The Seller shall be entitled to alter these Terms and Conditions at any time, but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.

GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

REMITTANCE TERMS PRICE AND PAYMENT

  1. The Price of the Goods shall be that stipulated on the Sellers Website. All European events are non-vatable and UK Events are inclusive of VAT at the current standard rate.
  2. The total purchase price including delivery charges, if any, will be displayed in the Buyers shopping cart prior to confirming the order.
  3. After the order is received the Seller shall confirm by email the details, description and price for the Goods together with information on the right to cancel if the Buyer is a Consumer.
  4. Payment of the Price and delivery charges must be made in full before dispatch of the Goods.

SUITABLE EQUIPMENT AND INSURANCE

It is the responsibility of the customer to ensure they have suitable equipment to undertake the event purchased.  These include a well maintained bike, full 360 degree zip together leathers or one piece leathers, leather boots and long leather gloves.

Unfortunately, no refunds given that do not meet these minimum

It is mandatory on European Events for all riders to ensure they have taken full repatriation insurance for the entire event.  This is the sole responsibility of the rider.

For transporting of the motorcycles, the stillages that No Limits Trackdays Limited utilises is for a standard sport style motorcycle of sensible size. If your bike does not fit on the Stillage, we reserve the right to charge you the additional bike space to transport your correctly to the event.

At all times the responsibility is of the rider to ensure that there bike is correctly placed in the stillage and secured, No Limits Trackdays Limited cannot not be held responsible for any damage to bikes due to incorrect package or securing.

All screens should be removed whilst in transport.

LICENCES

Riders over the age of 18:

All MSV (Motorsport Vision circuits), Brands Hatch, Cadwell Park, Oulton Park, Snetterton, Bedford Circuit and Donington Park insist that the production of a valid full motorcycle road bike licence or an ACU licence to ride at these circuits.

Unfortunately, restricted licences are not accepted at these Circuits, and you will be not being allowed to ride. No Limits will not be able to offer a refund or credit under these circumstances.

Other circuits, including Croft, Mallory, Anglesey, Lydden and Rockingham, do not insist on production of any form of licence, however, riding experience on the machine your riding is necessary.

Silverstone insist that the production of a valid motorcycle road bike licence or an ACU Licence, however, they do accept restricted bike licences, subject that you are riding the bike in accordance to your age and licence.

Riders aged 16 – 18

All MSV circuits (mentioned above) you must have an ACU Licence, ride the bike associated with your licence and also require obtaining a dispensation for the riding that event, this is to be done by emailing into the office, providing your licence number, date of birth and a CV of your riding skills. You will not be able to ride the circuit without prior dispensation from.

Other circuits, including Croft, Mallory, Anglesey, and Lydden, you will be required to produce a valid motorcycle driving licence or an approved race Licence i.e ACU Licence.

Silverstone insist that the production of a valid motorcycle road bike licence or an ACU Licence, however, they do accept restricted bike licences, subject that you are riding the bike in accordance to you age and licence

Riders under the age of 16

At MSV circuits no riders allowed under the age of 16 are accepted.

At other circuits, No Limits accept riders aged 14 and above, however, No Limits do require an ACU licence for rider under the age of 16 should be presented, the rider must meet the stipluations as set in relation to the ACU licence, which include the bike of which they are riding.

EUROPEAN EVENTS

Riders must be over the age of 14-years old and hold an approved race licence i.e. ACU or equivalent or a motorcycle driving licence and must produce this at sign on.

Riders age 14 – 16 must seek written approval prior to booking onto an European event.

The exception is Le Mans, France where you must be over the age of 16.

Where Hotel accommodation is included, this is based on a twin share basis. If you require a single room this is at an extra charge. If you do not know anyone to share with you will be put in a room with another suitable rider. In the event that there is no one travelling on their own that we can share you with, you will be liable for a single room supplement. 

NOISE LEVELS

Noise levels are set at each circuit, and this range from 98db to 105db static. Please check the details on the date that you are booking to what the noise level restrictions are. In many cases the static test is used as a guideline for the actual drive by level,that is required by Local Authorities, should you fail this you will need to reduce your noise level and retake the test. Most race exhaust end cans that have been repacked recently should pass this. If your motorcycle exceeds this noise limit, the circuit may prevent you from riding. No Limits Trackdays Ltd accepts no responsibility and will offer no refund or credit in this instance.

DRUGS & ALCOHOL

The use of drugs and alcohol at No Limits Trackdays Ltd events are forbidden. Infringement of this rule will result in riders being refused track time and no refund or credit will be given.

SIGN ON

All riders must complete the No Limits Trackdays Ltd UK disclaimer form before the day of the event and also watch the on-line briefing on ALL trackdays within the UK, at https://signon.nolimitstrackdays.com/.

For European Events all riders complete the No Limits Trackdays Ltd European disclaimer form on the day of the event and attended a compulsory briefing prior to going on circuit.

COMPULSORY RIDER BRIEFING

For all UK Event All riders must watch the compulsory online briefing and attend the individual circuit briefing given by No Limits/circuit staff at the beginning of the day.

For all European events All riders must attend the compulsory briefing given by No Limits/circuit staff at the beginning of the day.

A further briefing for the “lower” group will usually follow, to provide “lower” track riders with further details and the opportunity for them to ask questions. Attendance of the briefing will be validated by a wristband or sticker for their bike.

Wristbands and stickers will be checked by No Limits/circuit staff prior to each group riding on circuit and should therefore be worn all day. Tampering with wristbands/stickers in any way may result in the rider being removed without a refund or credit.

For late arrivals riders, there will be the facility of at one to one sign on and briefing.

RULES ON CIRCUIT

Riders are requested to ride safely and with respect to other track users. The onus to overtake safely is on the rider behind doing the overtaking. Riders who are seen to be riding disrespectfully and/or dangerously will be warned once. A second incident will result in the rider being removed from the circuit with no recourse to a refund or credit. Riders who are disrespectful and/or dangerous will not be permitted on further No Limits events. No Limits Trackdays Limited is not a race school, and lap timers are not permitted, and will be confiscated.

NO LIMITS INSTRUCTORS

No Limits Trackdays Limited has trained instructors who are available at all our track days for advice and instruction. They can lead or follow you round on track. The instructors are happy to brief you prior to your session to find out what elements of track riding you want to focus on. They will also provide you with a debrief following your session on circuit with them.
